1. Who you are contracting with

BrainBite Video is supplied by BrainBite B.V., Koningsweg 101, 5211 BH 's-Hertogenbosch, the Netherlands, registered with the Dutch Chamber of Commerce under number 42044611. Contact us at support@brainbite.ai for Video, including support, complaints, refunds and rights reports. General company information is available at https://www.brainbite.ai; the general contact address is info@brainbite.ai.

These standalone Video terms govern this service. Terms for BrainBite's other products do not automatically govern Video. A specific written agreement with your organisation takes priority for the matters it expressly covers. Mandatory legal rights always take priority. An earlier promise or guarantee made to you is not removed by your acceptance of this version.

A consumer is a person acting mainly outside their trade, business or profession. An organisation or professional customer acts for business or professional purposes. Being an adult or having a paid account does not by itself make you a business customer.

2. Adult accounts and acceptance

You must be at least 18 to create and manage a Video account. If you act for an organisation, you must be authorised to bind it and use its material. Children can watch suitable videos under adult supervision without becoming account holders.

You enter into the Video agreement by affirmatively accepting the displayed terms when activating your account. A purchase is made when you confirm the paid order offered at checkout. We record the accepted version, account, language and time. Presenting the privacy notice informs you about processing; it is not consent to every use of personal data.

Give accurate account and billing information, protect your login and report suspected unauthorised access promptly. Use organisation membership and invitation features only with the relevant organisation's authority. You remain responsible for users you authorise, subject to applicable law; you are not automatically responsible for activity caused by a security failure on our side.

3. What Video does and what you need to check

Video helps turn your instructions and permitted source material into scripts, images, narration and video. Available features, generation limits and supported export or sharing options are shown in the product and your offer. You need a supported browser and a suitable internet connection. Keep your own copies of important source material and exported work.

AI can produce inaccurate facts, unsuitable images, incorrect pronunciation, biased material and other mistakes. Review the entire result for accuracy, rights, accessibility, age suitability and your learners' needs before use or sharing. Video assists educational preparation; it does not replace professional teaching judgement or determine a learner's assessment, admissions or entitlement to education.

Results, completion time and availability depend in part on third-party services. Similar inputs can produce different results, and different users can receive similar results. We do not promise uninterrupted service, uniqueness or a particular learning outcome. This does not reduce our duty to provide the agreed service or a consumer's rights when digital content or a digital service is defective.

4. Your material and permitted uploads

You retain the rights you hold in prompts, documents, images, recordings and other material you provide. You give BrainBite a non-exclusive permission, limited to providing the service, to host, copy, convert and process that material and pass the necessary portions to service providers for generation, safety checks, delivery and support. It is not a transfer of ownership or permission for unrelated advertising, research or general model training.

Only provide material you are entitled to upload and use for the intended video and audience. Obtain any necessary copyright, likeness, speaker and confidentiality permissions. Do not upload third-party secrets or material whose use with the disclosed providers is prohibited. Before transmission, confirm the rights needed for the material you select. An automated safety check does not verify those rights.

Self-service accounts must not upload identifiable pupils, pupil voices, pupil records or other information that identifies a pupil, including within documents and prompts. Use fictitious or sufficiently anonymised examples. A pupil's apparent consent is not enough to lift this restriction. Such school use requires an appropriate school agreement and verified arrangements with BrainBite first. Do not provide sensitive personal information unless we have explicitly agreed to that processing.

5. Recording your own voice

If you use the own-voice feature, only record your own adult voice. Before sending the recording, you must specifically confirm it is your voice and request creation and use of its synthetic version for narration in your videos. Microphone permission, general terms acceptance and another person's permission do not substitute for this request.

ElevenLabs processes the recording to create a synthetic voice. The privacy notice explains the data involved and how to request deletion or stop future use. You must not imitate another person, clone a pupil's voice, mislead an audience about who spoke, or use the voice to commit fraud or harassment. Label synthetic narration where required and do not remove required AI provenance or disclosures.

6. Using and sharing your results

You may use, download, edit, copy and share your generated results for personal education, professional teaching, paid tutoring and your organisation's educational activities, including providing lessons to paying learners. No separate written permission from BrainBite is needed for these ordinary uses. To the extent BrainBite holds rights needed for those uses, we grant you a non-exclusive licence to exercise them, subject to these terms and the rights in any included third-party material.

Selling standalone generated assets, operating an asset marketplace, or sublicensing a stock-content library is outside this standard educational permission and requires a separate written agreement. This restriction does not prohibit charging for teaching or tutoring using your videos. Platform code, branding, templates and assets provided separately from your generated results remain BrainBite's or their respective owners' property.

We do not promise that every generated result attracts copyright, is exclusive, is free of third-party rights, or is suitable for every commercial use. Check source licences, trademarks, likeness and other rights before publication. Your permission to use results does not grant rights in someone else's material and does not entitle you to access other users' private content.

7. Audiences, links and reports

Keep work private unless you choose to share it. A link available to anyone with the link can be forwarded. Public or community publication can make the video discoverable beyond your intended group. Review the chosen audience and the creator, profile or organisation information displayed with the video before publishing.

Recipients can make copies, recordings or screenshots. Turning sharing off or deleting a video does not recall copies already made or remove every external cache. Do not publish pupils' personal information, rights-infringing content, unlawful content or misleading impersonation.

Report suspected unlawful content, copyright or likeness infringement, unsafe material or privacy problems to support@brainbite.ai. Include the video URL, the issue, the relevant rights or circumstances and a way to contact you. We assess reports, may restrict access while investigating and inform affected users where appropriate. You can ask us to review a moderation decision through the same address.

8. Prices, credits and generation

The purchase screen states the price, currency, applicable taxes, billing interval, included credits and any trial before you confirm. Consumer prices include applicable VAT; any business price excluding VAT must be labelled. Optional purchases require your agreement. The order and its confirmation form part of your agreement.

Credits are the entitlement used for paid generation steps. The product shows the applicable credit cost or estimate before the operation. Credits may be reserved during generation and settled according to the completed steps. Regenerating or changing a result can require further credits. An estimate of video minutes is an illustration, not a promise of an exact output length or number of videos.

Your plan or credit-pack offer states its allocation and any applicable validity, renewal or carry-over conditions. We do not impose an undisclosed expiry through these terms. Credits are not money, transferable currency or a means of payment outside Video. Their treatment on refunds, closure or a failed generation remains subject to your purchase conditions and mandatory rights.

If generation fails or the charged credits appear incorrect, contact support with the video or operation details. We review the outcome and credit settlement and correct charges that were not owed. A technically completed result may still have a defect; credit settlement does not remove your right to complain about the service. Do not repeatedly restart an uncertain paid operation without first checking its status.

9. Trial, renewal and ordinary cancellation

Where offered to an eligible account, the subscription trial lasts three days. Checkout states its end, the subscription price and the subsequent billing interval. Unless you cancel before the displayed trial end, the subscription converts to the paid plan on those terms. Trial eligibility and credits are shown with the offer; a trial is not an unlimited entitlement to generate.

Subscriptions renew at the stated interval until cancelled. Cancel in Video's subscription settings or contact support@brainbite.ai. Ordinary cancellation takes effect at the end of the current billing period, or prevents paid conversion if completed before the trial ends, as confirmed for your subscription. You retain access for the remaining period where applicable.

Ordinary cancellation is separate from requesting a refund or exercising statutory withdrawal. The cancellation screen does not by itself promise an immediate refund. If you cancel within the guarantee period below, you are entitled to the guarantee; contact support if the refund is not shown. Closing an account is also not a substitute for resolving a billing dispute or requesting withdrawal.

10. The 14-day subscription guarantee

Every subscription customer, including consumers, professionals and schools, has our 14-day money-back guarantee. If you withdraw or cancel within 14 days after the subscription starts, we stop the subscription and refund all subscription payments made under it, without deducting for use during those days. If the subscription begins with a free trial, the 14 days start when the trial starts. Send the request before that period ends.

To use the guarantee, email support@brainbite.ai with your account email and a clear statement that you want to stop the subscription and receive the guarantee refund. A cancellation submitted within the period preserves the guarantee even if processing or your follow-up takes longer. We refund without undue delay and no later than 14 days after receiving your withdrawal or guarantee request, using the original payment method unless you agree otherwise, without refund fees.

This subscription guarantee does not itself extend to a separately purchased credit pack. Credit packs remain subject to the purchase offer, statutory withdrawal where applicable and rights concerning a defective or undelivered service. More favourable guarantees already offered to you remain valid.

11. Consumers' statutory withdrawal rights

A consumer who contracts at a distance generally has 14 days from conclusion of the agreement to withdraw without giving a reason. This is a statutory right distinct from our subscription guarantee. Where a trial is part of that agreement, the period starts when the agreement and trial start, not automatically at the first paid renewal. Any longer period resulting from mandatory law remains available.

Email support@brainbite.ai or write to BrainBite B.V. at the address in section 1 with an unequivocal withdrawal statement. Giving your name, account email, order or subscription reference and agreement date helps us identify it. You may use this form, but do not have to: 'I hereby withdraw from my agreement for [service or purchase], concluded on [date]. Name: [name]. Address: [address]. Account email/order: [details]. Date: [date].' Add a signature only if sent on paper. Sending the statement before the deadline is enough.

Accepting these terms or using Video is not a blanket waiver of withdrawal. If immediate performance requires a separate express request, acknowledgement or contract confirmation by law, those requirements must be met separately. We do not rely on this terms checkbox alone to take away withdrawal rights or deduct for performance. The subscription guarantee above applies even where a lawful exception to statutory withdrawal would otherwise apply.

We confirm receipt and make any refund required by withdrawal without undue delay and within the applicable statutory period, normally no later than 14 days after your notice, by the original payment method unless agreed otherwise and without refund fees. Businesses do not generally have the statutory consumer cooling-off right, but do have the subscription guarantee.

12. Defects and mandatory customer rights

Consumers retain all mandatory rights concerning supply and conformity of digital content and services, including necessary updates and available repair, restoration, price reduction, termination or refund remedies. Please tell us about a defect so we can investigate and put it right. No 'as is' statement, AI limitation, credit settlement or complaint procedure in these terms overrides those rights.

We will provide the service with reasonable care and skill. A dispute about the quality or delivery of a paid service can be raised through support even after the 14-day guarantee ends. We do not impose a shorter contractual deadline that extinguishes a mandatory claim.

13. Misuse, restrictions and termination

Do not use Video for unlawful content, child exploitation, harassment, discrimination, fraud, deceptive impersonation, malicious code, bypassing payment or access controls, or unauthorised automated extraction of the service or others' data. Do not remove legally required synthetic-media disclosures or present generated evidence as an authentic event or a person's real statement.

We may proportionately restrict a feature, remove content or suspend an account when necessary to address a security threat, unlawful content, serious misuse or unpaid charges. Where reasonably possible, we explain the reason and allow you to respond or remedy the issue. Urgent action may come first where delay would cause harm or breach the law. Contact support to challenge a decision.

You may stop using Video and request account closure. Suspension or termination does not automatically forfeit amounts you are legally entitled to recover. We consider outstanding purchases, lawful export needs and required records when resolving closure. The privacy notice describes retention and deletion. Download important work before closing your account.

14. Privacy and school arrangements

The Video Privacy Notice explains account data, uploads, voice recordings, AI processing, sharing, payments, technical data and your rights. Optional analytics, marketing and an own-voice feature request are separate choices; agreement to these terms is not agreement to unrelated processing.

Where a school determines the purposes of personal-data processing and BrainBite acts on its instructions, an appropriate written data-processing agreement must define the instructions, security, subprocessors, assistance and end-of-service treatment. Ordinary account acceptance alone is not that agreement and does not lift the self-service pupil-data restriction.

15. Changes to the service or terms

We may update Video to maintain security, meet legal requirements or improve functionality. For a material change to your agreement, price or paid service, we provide advance information explaining the change and when it applies. Where the law or your agreement requires acceptance or a right to cancel, we provide it. We do not retrospectively change completed purchases or remove an existing guarantee.

Each terms version states its date and can be saved or printed. A new version applies prospectively through the applicable notice and acceptance process. Mandatory consumer protections concerning changes to digital services, continued conformity and termination remain intact. If a clause is invalid, the remaining terms continue insofar as the law permits.

16. Responsibility and liability

BrainBite is responsible for its contractual and legal obligations. For consumers, liability and remedies follow applicable law; the business limitation in the next paragraph does not apply to them. Nothing excludes mandatory consumer rights, personal-data rights, liability that cannot lawfully be limited, or liability for intentional misconduct or deliberate recklessness by BrainBite or its management.

For professional and organisation customers only, and to the extent legally permitted, our liability for an event or connected series of events is limited to the fees paid or payable for Video in the 12 months before the event. Within that scope we do not compensate indirect loss such as lost profit, missed savings or business interruption. This limitation does not apply to death or personal injury, intentional misconduct or deliberate recklessness by our management, or other liability that mandatory law prohibits limiting, including applicable data-protection claims.

Your duty to review content and use permitted material does not exempt us from our own failures. We do not impose an unlimited indemnity for every claim involving generated content. Each party's responsibility is assessed under these terms and applicable law.

17. Complaints, law and disputes

Send complaints to support@brainbite.ai with your account details and an explanation. We acknowledge receipt within 14 days and aim to resolve the complaint promptly. If more time is needed, we explain the next step. This process does not prevent you from pursuing a legal remedy or contacting a competent regulator.

Dutch law governs the agreement. A consumer also retains the mandatory protections of the law that would otherwise apply in their country of habitual residence. Consumers may bring proceedings before a court available to them under mandatory jurisdiction rules; these terms do not require them to use only a Dutch court. For business disputes, the competent Dutch court handles the matter unless a written agreement or mandatory rule provides otherwise.

The Dutch and English versions convey the same agreement. If their wording differs, interpret it in light of the customer's offer, mandatory law and the original purpose of the clause. No language-precedence rule overrides consumer protections.
